But how do you recognise whether a website, app or digital document is accessible?<\/p>\n<p>First of all, technical tools help with the initial assessment: WAVE, axe or the Google Lighthouse Audit can be used to uncover typical sources of errors such as missing alternative texts, insufficient colour contrasts or unusable forms. These tools analyse the source code and check whether common standards such as WCAG 2.1 AA are adhered to.<\/p>\n<p>Another indicator is usability with a keyboard: if you can operate a website completely without a mouse, you usually have a well-structured interface. The display with screen readers such as NVDA or VoiceOver is also a key test. If content is read aloud, but important buttons are not recognisable or sequences get mixed up, for example, there is a need for action.<\/p>\n<p>But technical tests alone are not enough. The crucial question is: can real users with disabilities understand and use the content? It is therefore essential to involve test subjects with visual impairments, motor impairments or cognitive challenges. applications:<\/p>\n<p>recorded time-based media published before 28 June 2025;<\/p>\n<p>File formats of office applications published before 28 June 2025;<\/p>\n<p>Online maps and map services, provided that essential information on maps for navigation purposes is provided in accessible digital form;<\/p>\n<p>Content from third parties that is neither financed nor developed by the economic operator concerned nor subject to its control;<\/p>\n<p>Content of websites and mobile applications that are considered archives, as their content will not be updated or revised after 28 June 2025.<\/p>\n<p>Sections 45a to 45d and 95a to 96 of the Copyright Act and Regulation (EU) 2017\/1563 of the European Parliament and of the Council of 13 September 2017 on the cross-border exchange of copies of certain works and other subject matter protected by copyright or related rights in an accessible format between the European Union and third countries for the benefit of persons who are blind, visually impaired or otherwise print-disabled (OJ L 242, 20.9.2017, p. 1) shall remain unaffected by this Act.<\/p>\n<ul>\n<li><strong> 2 BFSG Definitions<\/strong><\/li>\n<\/ul>\n<p>For the purposes of this Act<\/p>\n<p>\"Persons with disabilities\" means persons who have long-term physical, mental, intellectual or sensory impairments which, in interaction with attitudinal and environmental barriers, may prevent them from participating in society on an equal basis with others; long-term is defined as a period that is highly likely to last longer than six months;<\/p>\n<p>'product' means a substance, preparation or good produced by a manufacturing process, with the exception of food, feed, live plants and animals, products of human origin and products of plants and animals directly related to their future reproduction;<\/p>\n<p>'service' means a service within the meaning of Article 4(1) of Directive 2006\/123\/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market (OJ L 376, 27.12.2006, p. 36);<\/p>\n<p>'service provider' means any natural or legal person or partnership with legal personality providing or offering to provide a service to consumers on the Union market;<\/p>\n<p>'audiovisual media services' means services as defined in Article 1(1)(a) of Directive 2010\/13\/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of whose main purpose is to provide access to audiovisual media services;<\/p>\n<p>'telecommunications services' means a telecommunications service within the meaning of Article 2(4) of Directive (EU) 2018\/1972 of the European Parliament and of the Council of 11 December 2018 establishing the European Electronic Communications Code (OJ L 321, 17.12.2018, p. 36; L 334, 27.12.2019, p. 164);<\/p>\n<p>\"Text in real time\" means a form of text-based communication in point-to-point or multipoint connections, whereby the entered text is sent in such a way that the communication is perceived by the user as continuous character by character;<\/p>\n<p>'making available on the market' means any supply of a product for distribution, use or consumption on the Union market in the course of a commercial activity, whether in return for payment or free of charge;<\/p>\n<p>\"placing on the market\" means the first making available of a product on the Union market;<\/p>\n<p>\"Manufacturer\" means any natural or legal person or partnership with legal capacity that manufactures a product or has a product developed or manufactured and markets this product under its own name or brand;<\/p>\n<p>'authorised representative' means any natural or legal person or partnership with legal personality established within the European Union who has received a written mandate from a manufacturer to perform specific tasks on his behalf;<\/p>\n<p>\"importer\" means any natural or legal person or partnership with legal personality established in the European Union who places a product from a third country on the Union market;<\/p>\n<p>'distributor' means any natural or legal person or partnership with legal personality in the supply chain who makes a product available on the market, other than the manufacturer or the importer;<\/p>\n<p>\"economic operator\" means a manufacturer, authorised representative, importer, distributor or service profession;<\/p>\n<p>\"Micro-enterprise\" means an enterprise which employs fewer than ten persons and which either has an annual turnover of no more than EUR 2 million or an annual balance sheet total of no more than EUR 2 million;<\/p>\n<p>\"small and medium-sized enterprises\" means enterprises that employ fewer than 250 people and either have an annual turnover of no more than 50 million euros or an annual balance sheet total of no more than 43 million euros, with the exception of micro-enterprises;<\/p>\n<p>'harmonised standard' means a harmonised standard within the meaning of Article 2(1)(c) of Regulation (EU) No 1025\/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation (c) Regulation (EU) No 1025\/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89\/686\/EEC and 93\/15\/EEC and Directives 94\/9\/EC, 94\/25\/EC, 95\/16\/EC, 97\/23\/EC, 98\/34\/EC, 2004\/22\/EC, 2007\/23\/EC, 2009\/23\/EC and 2009\/105\/EC of the European Parliament and of the Council and repealing Council Decision 87\/95\/EEC and Decision No 1673\/2006\/EC of the European Parliament and of the Council (OJ L 316, 14.11.2012, p. 12);<\/p>\n<p>'technical specification' means a technical specification within the meaning of Article 2(4) of Regulation (EU) No 1025\/2012 that constitutes a means of meeting the accessibility requirements applicable to a product or service;<\/p>\n<p>'CE marking' means the marking by which the manufacturer indicates that the product is in conformity with the applicable requirements set out in European Union harmonisation legislation providing for its affixing;<\/p>\n<p>\"Market surveillance authority\" means any authority that is responsible for carrying out market surveillance under national law;<\/p>\n<p>'withdrawal' means any measure intended to prevent a product in the supply chain from being made available on the market or to withdraw a product made available on the market from the market;<\/p>\n<p>\"Consumer banking services\" means the provision of the following banking and financial services to consumers:<\/p>\n<p>Credit agreements within the meaning of Directive 2008\/48\/EC of the European Parliament and of the Council of 23 April 2008 on credit agreements for consumers and repealing Council Directive 87\/102\/EEC (OJ L 133, 22.5.2008, p. 66). 66), provided that the limit laid down in Article 2(2)(c) of Directive 2008\/48\/EC does not apply, or credit agreements within the meaning of Directive 2014\/17\/EU of the European Parliament and of the Council of 4 February 2014 on credit agreements for consumers relating to residential immovable property and amending Directives 2008\/48\/EC and 2013\/36\/EU and Regulation (EU) No 1093\/2010 (OJ L 60, 28.2.2014, p. 34);<\/p>\n<p>Services in accordance with Annex I, Section A, points 1, 2, 4 and 5 and Section B, points 1, 2, 4 and 5 of Directive 2014\/65\/EU of the European Parliament and of the Council of 15 May 2014 on markets in financial instruments and amending Directives 2002\/92\/EC and 2011\/61\/EU (OJ L 173, 12.6.2014, p. 34; L 74, 18.3.2015, p. 38; L 188, 13.7.2016, p. 28; L 273, 8.10.2014, p. 34) L 173, 12 June 2014, p. 349; L 74, 18 March 2015, p. 38; L 188, 13 July 2016, p. 28; L 273, 8 October 2016, p. 35; L 64, 10 March 2017, p. 116; L 278, 27 October 2017, p. 56), as last amended by Regulation (EU) 2019\/2115 (OJ L 30, 11.12.2019, p. 1);<\/p>\n<p>Payment services pursuant to Section 1 (1) sentence 2 of the Payment Services Supervision Act of 17 July 2017 (Federal Law Gazette I p. 2446), which was last amended by Article 9 (8) of the Act of 9 December 2020 (Federal Law Gazette I p. 2773);<\/p>\n<p>services associated with a payment account in accordance with Section 2 (2) of the Payment Accounts Act of 11 April 2016 (Federal Law Gazette I p. 720), which was last amended by Article 9 (7) of the Act of 9 December 2020 (Federal Law Gazette I p. 2773) and<\/p>\n<p>E-money in accordance with Section 1 (2) sentence 3 of the Payment Services Supervision Act;<\/p>\n<p>\"payment terminal\" means a device whose main purpose is to make payments using payment instruments within the meaning of Section 1(20) of the Payment Services Supervision Act at a physical point of sale, but not in a virtual environment;<\/p>\n<p>\"e-commerce services\" means telemedia services offered via websites and applications on mobile devices that are provided electronically and at the individual request of a consumer with a view to concluding a consumer contract;<\/p>\n<p>'air passenger transport services' means commercial passenger air services as defined in Article 2(l) of Regulation (EC) No 1107\/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air (OJ L 204, 26.7.2006, p. 1; OJ R 026, 26.01.2013, p. 34). 34) when departing from, arriving at or transiting through an airport situated in the territory of a Member State; including flights departing from an airport situated in a third country to an airport situated in the territory of a Member State when these services are operated by an air carrier from the European Union;<\/p>\n<p>'bus and coach passenger transport services' means services covered by Article 2(1) and (2) of Regulation (EU) No 181\/2011 of the European Parliament and of the Council of 16 February 2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006\/2004 (OJ L 55, 28.2.2011, p. 1);<\/p>\n<p>'rail passenger transport services' means all rail journeys and services as defined in Article 2(1) of Regulation (EC) No 1371\/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers' rights and obligations (OJ L 315, 3.12.2007, p. 14), with the exception of the services referred to in Article 2(2) of that Regulation;<\/p>\n<p>'maritime passenger transport services' means all passenger services as defined in Article 2(1) of Regulation (EU) No 1177\/2010 of the European Parliament and of the Council of 24 November 2010 concerning the rights of passengers when travelling by sea and inland waterway and amending Regulation (EC) No 2006\/2004 (OJ L 334, 17.12.2010, p. 1), with the exception of the services referred to in Article 2(2) of that Regulation;<\/p>\n<p>\"Urban and suburban transport services\" means transport services by rail, bus, underground, tram and trolleybus, the main purpose of which is to meet the transport needs of an urban area or a conurbation, including cross-border conurbations, as well as transport needs between an urban area or conurbation and the surrounding area;<\/p>\n<p>\"Regional transport services\" means transport services by rail, bus, underground, tram and trolleybus, the main purpose of which is to meet the transport needs of a region, including cross-border transport;<\/p>\n<p>\"assistive technologies\" means any element, device or product system, including software,<\/p>\n<p>that is used to increase, maintain, replace or improve the functional abilities of people with disabilities, or<\/p>\n<p>which serves to alleviate and compensate for disabilities, impairments of activity or impairments of the participation of people with disabilities;<\/p>\n<p>\"operating system\" means the software that, among other things, controls the interface to peripheral hardware, schedules tasks, allocates memory, and displays a standard interface to the consumer when no user program is running, including a graphical user interface, regardless of whether that software is an integral part of the consumer general purpose computer hardware or is external software intended to run on the consumer general purpose computer hardware; it excludes operating system loaders, a BIOS or other firmware required when booting up or installing the operating system;<\/p>\n<p>\"Hardware system for universal computers for consumers\" means the combination of hardware,<\/p>\n<p>which constitutes a complete computer and is characterised by its multipurpose nature and its ability to perform, with the appropriate software, the usual computer tasks required by the consumer, and<\/p>\n<p>is intended to be operated by consumers; including personal computers, in particular desktops, notebooks, smartphones and tablets;<\/p>\n<p>\"interactive feature set\" means the functionality to support human-device interaction to enable the processing and transmission of data, voice or video, or any combination thereof;<\/p>\n<p>\"E-book and dedicated software\"<\/p>\n<p>a service consisting of the provision of digital files that transmit an electronic version of a book and enable access, browsing, reading and use, and<\/p>\n<p>the software specifically designed to access, navigate, read and use the digital files concerned, including services and mobile applications offered on mobile devices and excluding software for e-book readers referred to in point 38;<\/p>\n<p>\"e-book reader\" means a specialised device, including hardware and software, used to access, navigate, read and use e-book files;<\/p>\n<p>'electronic tickets' means systems in which a travel authorisation in the form of a ticket for a single journey or multiple journeys, a season ticket or a travel credit is not printed on paper but is stored electronically on a physical ticket or other device;<\/p>\n<p>'electronic ticketing services' means systems in which travel authorisations are purchased, inter alia, online using an interactive-enabled device and transmitted electronically to the purchaser so that they can be printed out in paper form or displayed during the journey using an interactive-enabled device;<\/p>\n<p>\"Putting into use\" means the initial opening of the possibility to use a self-service terminal.<\/p>\n<ul>\n<li><strong> 3 BFSG Accessibility, authorisation to issue ordinances<\/strong><\/li>\n<\/ul>\n<p>Products that an economic operator makes available on the market and services that it offers or provides must be accessible. 2Products and services are barrier-free if they can be found, accessed and used by persons with disabilities in the generally customary manner, without particular difficulty and in principle without outside assistance. 3The specific accessibility requirements for products and services under this paragraph shall be governed by the ordinance to be issued under paragraph 2.<\/p>\n<p>1The Federal Ministry of Labour and Social Affairs is authorised, in agreement with the Federal Ministry of Finance, the Federal Ministry of Health, the Federal Ministry for Economic Affairs and Energy and the Federal Ministry of Transport and Digital Infrastructure, to regulate specific requirements for the accessibility of products pursuant to Section 1 (2) and services pursuant to Section 1 (3) in accordance with the requirements of Annex I of Directive (EU) 2019\/882 of the European Parliament and of the Council of 17 April 2019 on accessibility requirements for products and services (OJ L 151, 7.6.2019, p. 70) by statutory order with the approval of the Bundesrat. April 2019 on accessibility requirements for products and services (OJ L 151, 7.6.2019, p. 70), in particular with regard to<\/p>\n<p>the design and manufacture of the products, including the user interface,<\/p>\n<p>the accessibility and organisation of the range and execution of services,<\/p>\n<p>the way in which information is provided, in particular on the use of the products, such as labelling, instructions for use, safety information and the functioning of the services, as well as the accessibility features and accessibility functions of the products and services and the possible use of assistive technologies.<\/p>\n<p>By statutory order in accordance with sentence 1, more specific provisions may also be issued insofar as accessibility requirements within the meaning of Annex I of Directive (EU) 2019\/882 have been specified by delegated acts of the European Commission in accordance with Article 4 (9) of this Directive.<\/p>\n<p>Paragraph 1 shall not apply to micro-enterprises that offer or provide services. The Federal Ministry of Labour and Social Affairs shall, in agreement with the Federal Ministry for Economic Affairs and Energy, draw up guidelines for micro-enterprises in order to facilitate the application of this Act. The Federal Ministry of Labour and Social Affairs shall be entitled to use the services of third parties when drawing up the guidelines in accordance with sentence 2.<\/p>\n<ul>\n<li><strong> 4 BFSG Presumption of conformity on the basis of harmonised standards<\/strong><\/li>\n<\/ul>\n<p>Products and services that comply with harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, shall be presumed to comply with the requirements of the ordinance to be issued in accordance with Section 3 (2), insofar as these requirements are covered by the standards concerned or by parts of these standards.<\/p>\n<ul>\n<li><strong> 5 BFSG Presumption of conformity on the basis of technical specifications<\/strong><\/li>\n<\/ul>\n<p>Products and services that comply with the technical specifications or parts thereof shall be presumed to fulfil the requirements of the ordinance to be issued in accordance with Section 3 (2), insofar as these are covered by the technical specifications or parts of these technical specifications.<\/p>\n<ul>\n<li><strong> 6 BFSG Obligations of the manufacturer<\/strong><\/li>\n<\/ul>\n<p>The manufacturer may only place a product on the market if<\/p>\n<p>the product has been designed and manufactured in accordance with the accessibility requirements of the ordinance to be issued pursuant to Section 3 (2),<\/p>\n<p>the technical documentation has been prepared in accordance with Annex 2, the conformity assessment procedure has been carried out and the conformity of the product with the applicable accessibility requirements has been demonstrated as part of this procedure,<\/p>\n<p>the manufacturer has issued an EU Declaration of Conformity in accordance with \u00a7 18 and<\/p>\n<p>the CE marking has been affixed in accordance with \u00a7 19.<\/p>\n<p>The manufacturer shall keep the technical documentation and the EU declaration of conformity in written or electronic form for a period of five years after the product has been placed on the market.<\/p>\n<p>The manufacturer shall use suitable procedures to ensure that conformity with the requirements of this Act is always guaranteed, even in the case of series production. Changes to the design of the product or its characteristics as well as changes to the standards or technical specifications referred to in \u00a7\u00a7 4 and 5, to which reference is made in the declaration of conformity, must be taken into account appropriately.<\/p>\n<p>If a manufacturer is aware or has reason to believe that a product he has placed on the market does not comply with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), he shall immediately take the necessary corrective measures to ensure conformity. If conformity cannot be established, the manufacturer shall withdraw the product or recall it. If the product does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), the manufacturer shall immediately inform the market surveillance authority and the market surveillance authorities of the Member States of the European Union in which he has placed the product on the market. In doing so, he shall provide detailed information, in particular on the nature of the non-compliance and the corrective measures taken.<\/p>\n<p>The manufacturer shall keep a register of those products of which he has informed the market surveillance authorities of non-conformity with the applicable accessibility requirements and of complaints relating thereto. The register shall be kept in writing or electronically.<\/p>\n<ul>\n<li><strong> 7 BFSG Special labelling and information obligations of the manufacturer<\/strong><\/li>\n<\/ul>\n<p>The manufacturer shall ensure that the device bears a type, batch or serial number or other element allowing its identification in accordance with paragraph 4. Where this is not possible because of the size or nature of the device, the manufacturer shall ensure that the necessary information for identification is provided on the packaging or in a document accompanying the device.<\/p>\n<p>When placing the product on the market, the manufacturer must indicate his name, company name or trade mark and his postal address on the product. If this is not possible due to the size or nature of the product, this information must be provided on the packaging or in a document accompanying the product. The postal address must indicate a central point at which the manufacturer can be contacted. The contact details must be written in a language that can be easily understood by the consumer.<\/p>\n<p>The manufacturer shall ensure that the product is accompanied by instructions for use and safety information in German in accordance with paragraph 4.<\/p>\n<p>All labelling, the instructions for use and the safety information must be clear, comprehensible and unambiguous in accordance with the requirements of the ordinance to be issued pursuant to Section 3 (2).<\/p>\n<p>The manufacturer is obliged to provide the market surveillance authority, at its reasoned request, with all information and documents necessary to demonstrate conformity. The information and documentation shall be provided and handed over in German or in a language which can be easily understood by the German market surveillance authority. The manufacturer shall co-operate with the market surveillance authority, at its request, on any action taken to bring a product which it has placed on the market into conformity with the applicable accessibility requirements and, in particular, to bring the product into conformity with the applicable accessibility requirements.<\/p>\n<ul>\n<li><strong> 8 BFSG Authorised representative of the manufacturer<\/strong><\/li>\n<\/ul>\n<p>The manufacturer may appoint an authorised representative in writing.<\/p>\n<p>The authorised representative performs the duties assigned to him by the manufacturer for and on behalf of the manufacturer.<\/p>\n<p>A manufacturer who appoints an authorised representative must assign at least the following duties to the authorised representative:<\/p>\n<p>the obligation to keep the EU Declaration of Conformity and the technical documentation in accordance with Section 6 (2) for the market surveillance authority for a period of five years;<\/p>\n<p>the obligation to provide the market surveillance authority with all information in accordance with Section 7 (5) sentence 1 and to hand over all documents in accordance with Section 7 (5) sentence 1;<\/p>\n<p>the obligation to co-operate with the market surveillance authority, at its request, on any action taken to achieve conformity, insofar as the products concerned fall within the scope of the authorised representative's tasks.<\/p>\n<p>The manufacturer may not transfer the obligations under Section 6 (1) No. 1 and the obligation to prepare the technical documentation under Section 6 (1) No. 2 to an authorised representative.<\/p>\n<ul>\n<li><strong> 9 BFSG General obligations of the importer<\/strong><\/li>\n<\/ul>\n<p>The importer may only place products on the market that fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2).<\/p>\n<p>The importer may only place a product on the market if<\/p>\n<p>the manufacturer has carried out the conformity assessment procedure in accordance with Annex 2,<\/p>\n<p>the manufacturer has prepared the technical documentation required in accordance with Annex 2,<\/p>\n<p>the product is labelled with the CE mark in accordance with \u00a7 19,<\/p>\n<p>the product is accompanied by instructions for use and safety information, and<\/p>\n<p>the manufacturer has fulfilled the obligations in accordance with Section 7 (1) and (2).<\/p>\n<p>If an importer is aware or has reason to believe that a product does not fulfil the accessibility requirements of this Act, he may not place this product on the market until it has been brought into conformity. 2If the product does not fulfil the accessibility requirements, the importer shall also inform the manufacturer and the market surveillance authorities.<\/p>\n<p>As long as a product is in the importer's area of responsibility, the importer must ensure that the storage or transport conditions do not impair the compliance of the product with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2).<\/p>\n<p>6 paragraphs 4 and 5 apply accordingly.<\/p>\n<ul>\n<li><strong> 10 BFSG Special labelling and information obligations of the importer<\/strong><\/li>\n<\/ul>\n<p>When placing the product on the market, the importer must indicate his name, company name or trade mark as well as his postal address on the product. If this is not possible due to the size or nature of the product, the information must be provided on the packaging or in a document accompanying the product. 3The contact details must be written in a language that can be easily understood by the consumer.<\/p>\n<p>The importer shall ensure that the product is accompanied by instructions for use in accordance with the requirements of the ordinance to be issued pursuant to Section 3 (2) and by safety information in German corresponding to these requirements.<\/p>\n<p>The importer must keep a copy of the EU declaration of conformity at the disposal of the market surveillance authorities for a period of five years after the product has been placed on the market and ensure that he is able to submit the technical documentation at their request.<\/p>\n<p>7 paragraph 5 applies accordingly.<\/p>\n<ul>\n<li><strong> 11 BFSG Obligations of the retailer<\/strong><\/li>\n<\/ul>\n<p>The retailer may only make a product available on the market if<\/p>\n<p>the product is labelled with the CE mark in accordance with \u00a7 19,<\/p>\n<p>the product is accompanied by the documents in accordance with \u00a7 7 paragraph 3,<\/p>\n<p>the manufacturer has fulfilled his obligations under \u00a7 7 (1) and (2) and<\/p>\n<p>the importer has fulfilled his obligations under Section 10 (1) and (2).<\/p>\n<p>1If the distributor is aware or has reason to believe that a product does not comply with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), he may not make this product available on the market until conformity has been established. 2If the product does not comply with the applicable accessibility requirements, the distributor shall also immediately inform the manufacturer or importer and the market surveillance authorities.<\/p>\n<p>As long as a product is in the distributor's area of responsibility, the distributor must ensure that the storage or transport conditions do not impair the conformity of the product with the requirements of the ordinance to be issued in accordance with Section 3 (2).<\/p>\n<p>6 (4) and \u00a7 7 (5) apply accordingly.<\/p>\n<ul>\n<li><strong> 12 BFSG Importer or distributor as manufacturer<\/strong><\/li>\n<\/ul>\n<p>Sections 6 and 7 shall apply mutatis mutandis to an importer or trader if he<\/p>\n<p>places a product on the market under its own name or trade mark, or<\/p>\n<p>modifies a product already placed on the market in such a way that its conformity with the requirements of the ordinance to be issued pursuant to Section 3 (2) may be impaired.<\/p>\n<ul>\n<li><strong> 13 BFSG Specification of economic operators, authorisation to issue ordinances<\/strong><\/li>\n<\/ul>\n<p>The economic operator must provide the market surveillance authority with information on the economic operators at the latter's request,<\/p>\n<p>from which he has purchased a product and<\/p>\n<p>to whom he has delivered a product.<\/p>\n<p>The economic operator shall ensure that it can provide the information referred to in paragraph 1 for at least five years from the date of purchase or supply of the product.<\/p>\n<p>The Federal Ministry of Labour and Social Affairs shall be authorised to extend the period specified in paragraph 2 for individual products by ordinance subject to the approval of the Bundesrat, in agreement with the Federal Ministry for Economic Affairs and Energy, if this appears necessary with regard to the economic life of the product.<\/p>\n<ul>\n<li><strong> 14 BFSG Obligations of the service provider<\/strong><\/li>\n<\/ul>\n<p>The service provider may only offer or provide its service if<\/p>\n<p>the service fulfils the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) and<\/p>\n<p>he has prepared the information in accordance with Annex 3 number 1 and has made this information accessible to the general public in barrier-free form; the provisions of the ordinance to be issued in accordance with Section 3 (2) shall be decisive for making this information accessible.<\/p>\n<p>The service provider shall retain the information referred to in paragraph 1 number 2 for as long as he offers or provides the service.<\/p>\n<p>The service provider shall ensure that the accessibility requirements of the ordinance to be issued in accordance with Article 3 (2) are always met when offering or providing a service. It shall take due account of changes in the manner in which the service is provided, changes in the applicable accessibility requirements and changes in the harmonised standards or technical specifications referred to in the declaration of compliance of the service with the accessibility requirements.<\/p>\n<p>In the event of non-conformity, the service provider shall take the necessary corrective measures to bring the service into conformity with the accessibility requirements of the regulation to be adopted pursuant to Article 3(2). If the service does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Article 3(2), the service provider shall immediately inform the market surveillance authority and the market surveillance authorities of the Member States of the European Union in which he offers or provides the service. 3 In doing so, he shall provide detailed information, in particular on the nature of the non-compliance and the corrective measures taken.<\/p>\n<p>The service provider shall, further to a reasoned request from a market surveillance authority, provide it with all the information necessary to demonstrate the conformity of the service in accordance with paragraph 1. He shall co-operate with the market surveillance authority, at its reasoned request, on any action taken to bring the service into conformity.<\/p>\n<ul>\n<li><strong> 15 BFSG Counselling services from the Federal Accessibility Agency<\/strong><\/li>\n<\/ul>\n<p>The advice provided by the Federal Accessibility Agency in accordance with Section 13 (2) sentence 2 of the Disability Equality Act of 27 April 2002 (Federal Law Gazette I p. 1467, 1468), which was last amended by Article 3 of the Act of 10 July 2018 (Federal Law Gazette I p. 1117), as amended, includes advice for micro-enterprises in order to make it easier for them to apply this Act. The counselling pursuant to sentence 1 also includes counselling for micro-enterprises that offer and wish to provide accessible services.<\/p>\n<ul>\n<li><strong> 16 BFSG Fundamental changes<\/strong><\/li>\n<\/ul>\n<p>The accessibility requirements of the ordinance to be adopted pursuant to Article 3(2) shall apply only to the extent that compliance with them does not require a substantial modification of a product or service that results in a fundamental change in the nature of the product or service. The relevant economic operator shall carry out an assessment of whether compliance with the accessibility requirements of the ordinance to be adopted pursuant to Article 3(2) would entail a fundamental change in the nature of the product or service.<\/p>\n<p>The economic operator shall document the assessment referred to in the second sentence of paragraph 1 and keep it for a period of five years from the last making available of a product on the market or from the last provision of a service. At the request of the market surveillance authority, he shall provide it with a copy of the assessment referred to in the second sentence of paragraph 1.<\/p>\n<p>Where the economic operator relies on the first sentence of paragraph 1 for a specific product or service, he shall immediately inform the market surveillance authority and the market surveillance authorities of the Member States of the European Union in which the product is placed on the market or the service is offered or provided.<\/p>\n<p>Paragraph 2 sentence 1 and paragraph 3 shall not apply to microenterprises dealing with devices. At the request of the market surveillance authority, microenterprises that are involved with products and that invoke paragraph 1 sentence 1 shall provide the authority with the relevant facts for the assessment in accordance with paragraph 1 sentence 2.<\/p>\n<ul>\n<li><strong> 17 BFSG Disproportionate burdens, authorisation to issue ordinances<\/strong><\/li>\n<\/ul>\n<p>The accessibility requirements of the ordinance to be issued in accordance with Article 3(2) shall only apply to the extent that compliance with them would not lead to a disproportionate burden on the economic operator concerned in accordance with Annex 4. The economic operator shall carry out a corresponding assessment.<\/p>\n<p>The economic operator shall document the assessment referred to in the second sentence of paragraph 1 and keep it for a period of five years after the last making available of a product on the market or after the last provision of a service. At the request of the market surveillance authority, he shall provide it with a copy of the assessment referred to in the second sentence of paragraph 1. Sentence 1 and sentence 2 shall not apply to microenterprises dealing with products. However, at the request of the market surveillance authority, microenterprises dealing with products and relying on the first sentence of paragraph 1 shall provide the authority with the facts relevant to the assessment referred to in the second sentence of paragraph 1.<\/p>\n<p>A service provider who invokes paragraph 1 sentence 1 shall carry out its assessment in accordance with paragraph 1 sentence 2 for each category or type of service at least every five years. The assessment in accordance with sentence 1 must always be carried out if<\/p>\n<p>the service offered is changed or<\/p>\n<p>the service provider is requested to do so by the authority responsible for checking the conformity of the service.<\/p>\n<p>If an economic operator receives non-proprietary public or private funds for the purpose of improving accessibility, it shall not be entitled to invoke the first sentence of paragraph 1.<\/p>\n<p>Where the economic operator relies on the first sentence of paragraph 1 for a specific product or service, he shall immediately inform the competent market surveillance authority or the authority responsible for verifying the conformity of services of the Member State in which the product is placed on the market or the service is offered or provided. Sentence 1 shall not apply to microenterprises.<\/p>\n<p>The Federal Ministry of Labour and Social Affairs is authorised, by ordinance subject to the approval of the Bundesrat and in agreement with the Federal Ministry of Finance and the Federal Ministry for Economic Affairs and Energy, to specify and supplement the criteria contained in Annex 4 which the economic operator must take into account in the assessment pursuant to paragraph 1.<\/p>\n<ul>\n<li><strong> 18 BFSG EU Declaration of Conformity for products<\/strong><\/li>\n<\/ul>\n<p>Before a product whose compliance with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) in the procedure set out in Annex 2 is placed on the market, the manufacturer must issue an EU Declaration of Conformity.<\/p>\n<p>The EU declaration of conformity shall state that the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) are demonstrably fulfilled. If use has been made of the possibility of an exemption in accordance with Sections 16 or 17, the EU declaration of conformity shall indicate which accessibility requirements are affected by this exemption.<\/p>\n<p>The EU declaration of conformity shall have the model structure set out in Annex III to Decision No 768\/2008\/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products, and repealing Council Decision 93\/465\/EEC (OJ L 218, 13.8.2008, p. 82). It contains the elements specified in Annex 2 and is kept up to date. It shall be translated into German. The requirements for the technical documentation shall not impose an excessive burden on micro, small and medium-sized enterprises.<\/p>\n<p>If the product is subject to several legal acts of the European Union, each of which requires an EU Declaration of Conformity, the manufacturer or his authorised representative shall draw up a single EU Declaration of Conformity for all legal acts of the European Union. This declaration shall specify the legal acts concerned and their references.<\/p>\n<ul>\n<li><strong> 19 BFSG CE marking<\/strong><\/li>\n<\/ul>\n<p>Before a product whose compliance with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) has been demonstrated in the conformity assessment procedure in accordance with Annex 2 is placed on the market, it shall be affixed with the CE marking in accordance with paragraph 2 by the manufacturer or his authorised representative, insofar as this has been delegated to him.<\/p>\n<p>The CE marking shall be affixed visibly, legibly and indelibly to the product or to its data plate. If the nature of the product does not permit or justify this, the CE marking shall be affixed to the packaging and accompanying documents.<\/p>\n<p>The general principles of Article 30 of Regulation (EC) No 765\/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Council Regulation (EEC) No 339\/93 (OJ L 218, 13.8.2008, p. 30; OJ L 169, 25.6.2019, p. 1), as amended, apply to the CE marking.<\/p>\n<ul>\n<li><strong> 20 BFSG Tasks of the market surveillance authorities<\/strong><\/li>\n<\/ul>\n<p>The federal states ensure that their market surveillance authorities can fulfil their tasks properly. To this end, they shall provide them with the necessary resources. They shall ensure efficient co-operation and an effective exchange of information between their market surveillance authorities and between their market surveillance authorities and those of the other Member States of the European Union.<\/p>\n<p>The federal states shall draw up a market surveillance strategy for products within the meaning of Section 1 (2). When drawing up this strategy, Article 13 (1) and (2) of Regulation (EU) 2019\/1020 of the European Parliament and of the Council of 20 June 2019 on market surveillance and compliance of products and amending Directive 2004\/42\/EC and Regulations (EC) No 765\/2008 and (EU) No 305\/2011 (OJ L 169, 25.6.2019, p. 1) shall apply mutatis mutandis to products within the meaning of Section 1 (2). The federal states shall submit their market surveillance strategy pursuant to sentence 1 to the central liaison body in accordance with Article 10(3) of Regulation (EU) 2019\/1020.<\/p>\n<ul>\n<li><strong> 21 BFSG Market surveillance measures<\/strong><\/li>\n<\/ul>\n<p>The market surveillance of products shall be carried out in accordance with the market surveillance strategy developed by the federal states in accordance with Section 20 (2) sentence 1 and the other provisions of this Act.<\/p>\n<p>Article 2(3), Article 11(2), (3) and (5), Article 14(2), Article 16(3)(g) and (5) and Articles 17 and 22 of Regulation (EU) 2019\/1020 shall apply mutatis mutandis to the market surveillance of products. The market surveillance authorities shall have the powers set out in Article 14(4)(a), (b), (e) and (j) of Regulation (EU) 2019\/1020. 3The powers set out in Article 14(4)(e) of Regulation (EU) 2019\/1020 shall only apply during normal operating and business hours.<\/p>\n<p>The market surveillance authority checks whether the manufacturer, importer or distributor has invoked \u00a7 16 or \u00a7 17,<\/p>\n<p>whether the economic operator has carried out the assessment required by the relevant regulation,<\/p>\n<p>the assessment, including the proper application of the criteria set out in Annex 4, and<\/p>\n<p>whether the other accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) are met.<\/p>\n<p>The market surveillance authority shall make the following available to a consumer on request in a form that is perceptible to him:<\/p>\n<p>the information available to it on whether a particular economic operator complies with the accessibility requirements of the ordinance to be adopted pursuant to Article 3(2), and<\/p>\n<p>the assessment carried out by the economic operator in accordance with Article 16 paragraph 1 sentence 2 and Article 17 paragraph 1 sentence 2.<\/p>\n<p>Where necessary, the market surveillance authority shall explain the information available to it in a simple and comprehensible manner. If such an explanation in accordance with sentence 2 is not sufficient for the consumer, the market surveillance authority shall explain the information in plain language. The obligation under sentence 1 shall not apply if the information cannot be provided for reasons of confidentiality in accordance with Article 17 of Regulation (EU) No. 2019\/1020.<\/p>\n<p>People with hearing impairments and people with speech impairments have the right to communicate with the market surveillance authority in German sign language, with sign language accompanying speech or via other suitable communication aids during the procedure in accordance with paragraph 4. The costs of communication aids shall be borne by the market surveillance authority. \u00a7 Section 5 of the Communication Aids Ordinance of 17 July 2002 (Federal Law Gazette I p. 2650), last amended by Article 12 (2) of the Act of 21 December 2020 (Federal Law Gazette I p. 3229), as amended, shall apply accordingly.<\/p>\n<p>Sections 10 and 11 of the Disability Discrimination Act apply accordingly to the procedure under paragraph 4.<\/p>\n<ul>\n<li><strong> 22 BFSG Market surveillance measures for products that do not fulfil the accessibility requirements<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority has reason to believe that a product does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), it shall check whether the product fulfils the requirements. Economic operators are obliged to co-operate fully with the market surveillance authority for this purpose.<\/p>\n<p>If the market surveillance authority comes to the conclusion that the product does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), it shall immediately request the economic operator concerned to take the appropriate measures to bring the product into conformity within a reasonable period of time set by it. For the hearing of the economic operator concerned in accordance with Section 28 of the Administrative Procedure Act or in accordance with the hearing regulations of the federal states corresponding to this provision, the hearing period may not be less than ten days.<\/p>\n<p>The economic operator shall ensure that the measures it takes to achieve compliance cover all the products concerned that it has made available on the European Union market.<\/p>\n<p>Where the economic operator does not take appropriate measures to bring the product into conformity within the period referred to in the first sentence of paragraph 2, the market surveillance authority shall take appropriate measures to restrict the product's being made available on the German market, prohibit its being made available on the market or ensure that it is withdrawn or recalled. If no economic operator is established in the internal market, the measures may be directed against anyone who carries out the transfer on behalf of the economic operator. Paragraph 2 sentence 2 applies accordingly. Where a measure has been taken without the economic operator concerned having been heard, he shall be given the opportunity to comment without delay. The measure shall be reviewed immediately in response to the comments.<\/p>\n<p>If the market surveillance authority has reason to believe that a non-compliance identified in accordance with paragraph 2 is not limited to the German territory, it shall take the measures referred to in paragraph 4 subject to the proviso that they are revoked if the European Commission determines, in accordance with Article 21(1) of Directive (EU) 2019\/882, that the measures are not justified.<\/p>\n<ul>\n<li><strong> 23 BFSG Measures in the event of formal non-conformity of products<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority identifies a formal non-conformity, it shall require the economic operator to rectify the formal non-conformity within a reasonable period of time. \u00a7 Article 22 paragraph 2 sentence 2 applies accordingly.<\/p>\n<p>Formal non-conformity exists if<\/p>\n<p>the CE marking has not been affixed or has been affixed in non-compliance with the requirements of \u00a7 19,<\/p>\n<p>the EU Declaration of Conformity according to \u00a7 18 has not been issued or has not been issued properly,<\/p>\n<p>the technical documentation is not available or not complete,<\/p>\n<p>the information provided by the manufacturer in accordance with \u00a7 7 paragraph 2 or the importer in accordance with \u00a7 10 paragraph 1 is missing, incorrect or incomplete, or<\/p>\n<p>another formal obligation according to \u00a7 6, \u00a7 7, \u00a7 9 or \u00a7 10 is not fulfilled.<\/p>\n<p>Where the economic operator does not take appropriate measures to bring the product into conformity within the time limit set in accordance with paragraph 1, the market surveillance authority shall take appropriate measures to restrict the making available of the product on the market or prohibit the making available on the market until conformity is established. \u00a7 Section 22 (2) sentence 2 and (4) sentences 4 and 5 shall apply mutatis mutandis.<\/p>\n<ul>\n<li><strong> 24 BFSG Obligations of the market surveillance authority and the Federal Institute for Occupational Safety and Health in the event of non-compliance of products that are not restricted to German territory<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority is of the opinion after the examination in accordance with \u00a7 22 paragraph 1 that the products complained of are also made available on the market in other Member States of the European Union, it shall immediately inform the Federal Institute for Occupational Safety and Health. It shall also inform the Federal Institute for Occupational Safety and Health of the result of the inspection in accordance with Article 22 (1) and of the measures it has requested the economic operator to take.<\/p>\n<p>If the market surveillance authority takes measures in accordance with \u00a7 22 paragraph 4, it shall immediately inform the Federal Institute for Occupational Safety and Health of the measures taken. The information shall contain all available details, in particular the data necessary for the identification of the product concerned, the origin of the product, the nature of the alleged non-compliance, the nature and duration of the measures taken and the arguments put forward by the economic operator concerned. The information shall also indicate whether the alleged non-compliance is due to the fact that<\/p>\n<p>the product does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) or<\/p>\n<p>the harmonised standards or the technical specifications with which a presumption of conformity applies in accordance with \u00a7\u00a7 4 and 5 are defective.<\/p>\n<p>The Federal Institute for Occupational Safety and Health shall check the information received in accordance with paragraphs 1 and 2 for completeness and conclusiveness. It shall forward this information to the European Commission and the other Member States of the European Union without delay.<\/p>\n<p>The market surveillance authority cancels the reservation of revocation in accordance with Section 22 (5) if<\/p>\n<p>the period of three months referred to in Article 20(7) of Directive (EU) 2019\/882 has elapsed without a Member State of the European Union having objected to the measures, or<\/p>\n<p>the European Commission has determined that the measures are justified in accordance with Article 21(1) of Directive (EU) 2019\/882.<\/p>\n<p>The market surveillance authority shall revoke the measures taken in accordance with Section 22 (4) if the European Commission determines in accordance with Article 21 (1) of Directive (EU) 2019\/882 that the measures are not justified.<\/p>\n<ul>\n<li><strong> 25 BFSG Support obligation<\/strong><\/li>\n<\/ul>\n<p>The market surveillance authorities and the Federal Institute for Occupational Safety and Health shall support each other and inform each other of measures taken in accordance with this Act.<\/p>\n<p>The Federal Institute for Occupational Safety and Health informs the market surveillance authorities about notifications from the European Commission or another member state of the European Union.<\/p>\n<ul>\n<li><strong> 26 BFSG Obligations of the market surveillance authority in the case of measures taken by other Member States, in the case of products that violate the accessibility requirements<\/strong><\/li>\n<\/ul>\n<p>Where the market surveillance authority is informed by the Federal Institute for Occupational Safety and Health that another Member State has taken a measure pursuant to Article 20(4) of Directive (EU) 2019\/882, it shall immediately verify whether that measure is justified. The market surveillance authority shall inform the national economic operators in an appropriate manner of the measure taken by the other Member State and give them the opportunity to comment. The time limit for commenting shall be four weeks from the possibility of being informed.<\/p>\n<p>If the market surveillance authority comes to the conclusion that the measure is not justified, it shall immediately forward its objections to the Federal Institute for Occupational Safety and Health in accordance with Article 20(6) of Directive (EU) 2019\/882. The Federal Institute for Occupational Safety and Health shall forward these objections to the European Commission and the other Member States without delay.<\/p>\n<p>If neither the European Commission nor one of the Member States of the European Union raises objections within a period of three months, the measure shall be deemed justified. In this case, the market surveillance authority shall take appropriate measures to restrict the making available of the product on the market or prohibit the making available on the market or ensure that the product is withdrawn or recalled. The market surveillance authority shall publicise the measures in an appropriate manner.<\/p>\n<p>Paragraph 3 shall also apply in cases where the European Commission has determined, in accordance with Article 21(1) of Directive (EU) 2019\/882, that the measure taken by another Member State is justified.<\/p>\n<ul>\n<li><strong> 27 BFSG Tasks of the central liaison office<\/strong><\/li>\n<\/ul>\n<p>The single liaison office shall inform the European Commission and the other Member States of the European Union:<\/p>\n<p>the market surveillance strategy submitted by the federal states in accordance with Article 20(2), and<\/p>\n<p>the market surveillance authorities and their respective responsibilities.<\/p>\n<p>For this purpose, it shall use the information and communication system referred to in Article 34 of Regulation (EU) 2019\/1020. The federal states shall provide the central liaison body with the information required in accordance with sentence 1 number 2.<\/p>\n<p>The central liaison office provides the public with a summary of the market surveillance strategy.<\/p>\n<p>The central liaison body shall, in coordination with the federal ministries concerned, perform the tasks set out in Article 31(2)(a), (f), (g) and (m) of Regulation (EU) 2019\/1020 with regard to market surveillance of accessibility requirements for products in accordance with Directive (EU) 2019\/882.<\/p>\n<ul>\n<li><strong> 28 BFSG Market surveillance of services<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority has reason to believe that the offer or provision of a service does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), it shall examine whether the service fulfils the requirements.<\/p>\n<p>The market surveillance authority shall check a service, even without a specific reason, on the basis of appropriate random samples in an appropriate manner and to an appropriate extent as to whether and to what extent the service fulfils the accessibility requirements of the accessibility ordinance to be issued in accordance with Section 3 (2). In the case of websites or mobile applications, it shall refer to the specifications in Annex 1 Number 1 and select the random samples of the services to be tested in accordance with the specifications in Annex 1 Number 2.<\/p>\n<p>The market surveillance authority shall check whether the service provider has invoked Section 16 or Section 17,<\/p>\n<p>whether the service provider has carried out the assessment required by the relevant regulation,<\/p>\n<p>the assessment, including the proper application of the criteria set out in Annex 4, and<\/p>\n<p>whether the other accessibility requirements are met.<\/p>\n<p>The market surveillance authority shall make the following available to a consumer on request in a form that is perceptible to him:<\/p>\n<p>the information available to it on whether a particular economic operator complies with the accessibility requirements of the ordinance to be adopted pursuant to Article 3(2), and<\/p>\n<p>the assessment made by the economic operator in accordance with Section 16 (1) sentence 2 or Section 17 (1) sentence 2.<\/p>\n<p>If necessary, the market surveillance authority shall explain the information available to it in a simple and comprehensible manner. If an explanation in accordance with sentence 2 is not sufficient for the consumer, the market surveillance authority shall explain the information in plain language. The obligation under sentence 1 shall not apply if the information cannot be provided for reasons of confidentiality in accordance with Article 17 of Regulation (EU) No 2019\/1020.<\/p>\n<p>People with hearing impairments and people with speech impairments have the right to communicate with the market surveillance authority in German sign language, with sign language accompanying speech or using other suitable communication aids during the procedure in accordance with paragraph 4. The costs of communication aids shall be borne by the market surveillance authority. \u00a7 Section 5 of the Communication Aids Ordinance applies accordingly.<\/p>\n<p>Sections 10 and 11 of the Disability Discrimination Act apply accordingly to the procedure under paragraph 4.<\/p>\n<ul>\n<li><strong> 29 BFSG Market surveillance measures for services that do not fulfil the accessibility requirements<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority comes to the conclusion that the service does not fulfil the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2), it shall immediately request the service provider to take appropriate measures to establish conformity within a reasonable period of time set by it. \u00a7 Section 22 (2) sentence 2 shall apply accordingly.<\/p>\n<p>If the service provider does not take appropriate corrective measures within the deadline set in accordance with paragraph 1, the market surveillance authority shall again request the service provider, under threat of prohibiting the offer or provision of the service, to take appropriate corrective measures within a reasonable deadline set by it in order to bring the service into compliance with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2). \u00a7 Section 22 (2) sentence 2 and (4) sentences 4 and 5 shall apply accordingly.<\/p>\n<p>If the service provider does not take appropriate corrective action within the period set in accordance with paragraph 2, the market surveillance authority shall take the necessary measures to remedy the non-compliance with the accessibility requirements of the ordinance to be issued in accordance with Article 3 paragraph 2. In particular, it may order the cessation of the offer or provision of the service within a period of time set by it. If the service provider proves to the market surveillance authority that the conformity of the service with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) has been established, the market surveillance authority shall revoke the order.<\/p>\n<ul>\n<li><strong> 30 BFSG Measures in the event of formal non-compliance of services<\/strong><\/li>\n<\/ul>\n<p>If the market surveillance authority identifies a formal non-conformity, it shall require the service provider to correct the formal non-conformity within a reasonable period of time. \u00a7 Section 22 (2) sentences 2 to 4 shall apply accordingly.<\/p>\n<p>Formal non-conformity exists if the necessary information in accordance with Annex 3 has not been prepared or has not been prepared in full or if the information has not been made accessible to the general public or has not been made accessible in full or in an accessible form.<\/p>\n<p>If the service provider fails to take appropriate corrective action within the time limit set in accordance with paragraph 1, the market surveillance authority shall again require the service provider to take appropriate corrective action to bring about conformity within a reasonable time limit set by it, on pain of prohibition of the offer or provision of the service. \u00a7 Section 22 (2) sentences 2 to 4 shall apply accordingly.<\/p>\n<p>If the service provider does not take appropriate corrective action within the time limit set in accordance with paragraph 3, the market surveillance authority shall take the necessary measures to remedy the formal non-compliance. If the service provider demonstrates that the conformity of the service has been established, the market surveillance authority shall cancel the order.<\/p>\n<ul>\n<li><strong> 31 BFSG Publication of information<\/strong><\/li>\n<\/ul>\n<p>The market surveillance authority must inform the public in an appropriate manner, for example on its website, about its existence, its responsibilities, how to contact it, its work and its decisions in an accessible manner.<\/p>\n<p>The market surveillance authority shall, upon request, provide a consumer with the information referred to in paragraph 1 in a form that he can perceive. Where necessary, the market surveillance authority shall explain the information to the applicant in a simple and comprehensible manner. If such an explanation is not sufficient for the applicant, the market surveillance authority shall explain the information in plain language.<\/p>\n<ul>\n<li><strong> 32 BFSG Rights of consumers, recognised associations and qualified institutions in administrative proceedings<\/strong><\/li>\n<\/ul>\n<p>At the request of a consumer, the market surveillance authority shall initiate proceedings for the implementation of measures pursuant to Section 6 or Section 7 of this Act against an economic operator if the consumer claims that the economic operator is in breach of a provision of this Act or a provision of the statutory order to be issued pursuant to Section 3 (2) and the consumer is therefore unable to use the product or service in question or can only use it in a restricted manner. The consumer has the right to instruct an association recognised under Section 15 (3) of the Disability Equality Act or a qualified institution within the meaning of Section 3 (1) no. 1 of the Injunctions Act in the version published on 27 August 2002 (Federal Law Gazette I p. 3422, 4346), which was last amended by Article 2 of the Act of 26 November 2020 (Federal Law Gazette I p. 2568), as amended, to apply in his or her name or on his or her behalf to initiate proceedings pursuant to sentence 1. 3On receipt of an application pursuant to sentence 1, the economic operator concerned shall be given the opportunity to comment.<\/p>\n<p>The proceedings pursuant to paragraph 1 sentence 1 against an economic operator shall also be initiated if an association recognised pursuant to Section 15 paragraph 3 of the Disability Equality Act or a qualified institution within the meaning of Section 3 paragraph 1 number 1 of the Injunctions Act applies for this under the conditions that the economic operator violates a provision of this Act or a provision of the ordinance to be issued pursuant to Section 3 paragraph 2 and the violation affects the respective statutory area of responsibility of the association or the qualified institution. The association or qualified entity must demonstrate in the application that its statutory remit is affected. In order to assert the right arising from sentence 1, the association does not need to have committed an infringement of its own.<\/p>\n<p>The market surveillance authority shall decide on an application in accordance with paragraph 1 or paragraph 2 by means of a decision.<\/p>\n<p>People with hearing impairments and people with speech impairments have the right to communicate in the administrative procedure in accordance with paragraph 1 and paragraph 2 in German sign language, with sign language or using other suitable communication aids. The costs of communication aids shall be borne by the market surveillance authority. \u00a7 Section 5 of the Communication Aids Ordinance applies accordingly.<\/p>\n<p>Sections 10 and 11 of the Disability Discrimination Act apply accordingly to the administrative procedure under this provision.<\/p>\n<ul>\n<li><strong> 33 BFSG Legal remedies<\/strong><\/li>\n<\/ul>\n<p>Subject to the requirements of Section 32 (1) sentence 1, the consumer has the right to instruct an association recognised under Section 15 (3) of the Disability Equality Act or a qualified institution within the meaning of Section 3 (1) sentence 1 number 1 of the Injunctions Act to lodge appeals in his or her name or on his or her behalf in accordance with the Administrative Court Code against the decision addressed to him or her under Section 32 (3) or against its omission. The power of representation pursuant to sentence 1 shall also apply before the Higher Administrative Court and the Federal Administrative Court. If the recognised association or the qualified institution acts on behalf of the consumer, the recognised association or the qualified institution may also conduct the legal dispute itself before the Higher Administrative Court and the Federal Administrative Court. Before the Federal Administrative Court, the recognised association or qualified institution must act through persons qualified to hold judicial office.<\/p>\n<p>An association recognised under Section 15 (3) of the Disability Equality Act or a qualified institution within the meaning of Section 3 (1) sentence 1 number 1 of the Injunctions Act may, without being infringed in its own rights, lodge an appeal in accordance with the Administrative Court Code against a decision addressed to it under Section 32 (3) or against its omission if it asserts that a provision of this Act or the statutory order to be issued under Section 3 (2) has been infringed and that the infringement affects the respective statutory remit of the recognised association or the qualified institution. The recognised association or qualified institution may also bring the legal dispute before the Higher Administrative Court and the Federal Administrative Court itself. Paragraph 1 sentence 4 applies accordingly.<\/p>\n<ul>\n<li><strong> 34 BFSG Arbitration<\/strong><\/li>\n<\/ul>\n<p>A consumer who claims that an economic operator is in breach of a provision of this Act or of the statutory order to be issued pursuant to Section 3 (2) and who is therefore unable to use the product or service in question or can only use it in a restricted manner is entitled to submit an application to the conciliation body pursuant to Section 16 (1) of the Disability Equality Act to initiate conciliation proceedings. At the request of the consumer, the conciliation body shall involve the market surveillance authority as a party to the conciliation proceedings. It shall send a copy of the request for conciliation to the economic operator and the market surveillance authority in order to carry out the conciliation procedure.<\/p>\n<p>In addition, an application for the initiation of arbitration proceedings for the out-of-court settlement of a dispute arising from a consumer contract or concerning the existence of such a contractual relationship may also be submitted to the arbitration board in accordance with paragraph 1.<\/p>\n<p>Paragraph 1 shall apply mutatis mutandis to an association recognised under Section 15 (3) of the Disability Equality Act or a qualified institution within the meaning of Section 3 (1) sentence 1 number 1 of the Injunctions Act which asserts that a provision of this Act or a provision of the statutory order to be issued under Section 3 (2) has been violated and the violation affects the respective statutory area of responsibility of the association or the qualified institution.<\/p>\n<p>Proceedings pursuant to section 32 (1) or (2) shall be suspended until the arbitration proceedings have been concluded.<\/p>\n<p>Otherwise, Section 16 (4) to (7) of the Disability Equality Act and the Disability Equality Conciliation Ordinance of 25 November 2016 (Federal Law Gazette I p. 2659), which was amended by Article 2 of the Ordinance of 21 May 2019 (Federal Law Gazette I p. 738), shall apply.<\/p>\n<ul>\n<li><strong> 35 BFSG Obligations of economic operators to provide information<\/strong><\/li>\n<\/ul>\n<p>Economic operators shall be obliged to provide the market surveillance authority, at its reasoned request, with the information necessary for the fulfilment of the tasks of the market surveillance authorities under this Act. A person obliged to provide information under this Act may refuse to answer questions if answering them would expose him or one of the relatives referred to in Section 383(1)(1) to (3) of the Code of Civil Procedure to the risk of criminal prosecution or proceedings under the Act on Regulatory Offences. He must be informed of his right to refuse to provide information.<\/p>\n<ul>\n<li><strong> 36 BFSG Reporting to the European Commission<\/strong><\/li>\n<\/ul>\n<p>In preparation for reporting to the European Commission, the federal states shall, at the request of the Federal Ministry of Labour and Social Affairs or an authority designated by this ministry and falling within its remit, provide this ministry or the aforementioned authority with all necessary information in accordance with Article 33 (3) in conjunction with (2) of Directive (EU) 2019\/882, in particular information on progress in the accessibility of products and services and on the impact of this Act on economic operators and persons with disabilities, within the set deadline. The federal states shall make this information available electronically.<\/p>\n<ul>\n<li><strong> 37 BFSG Fining provisions<\/strong><\/li>\n<\/ul>\n<p>Any person who wilfully or negligently<\/p>\n<p>places a product on the market in contravention of Section 6(1)(1) or Section 9(1), in each case in conjunction with an ordinance pursuant to Section 3(2),<\/p>\n<p>fails to provide information, or fails to provide it correctly, completely or in good time, contrary to Section 6 (4) sentence 3, also in conjunction with Section 11 (4), contrary to Section 11 (2) sentence 2 or Section 14 (4) sentence 2, in each case in conjunction with an ordinance pursuant to Section 3 (2),<\/p>\n<p>contrary to Section 7 (1) sentence 1, also in conjunction with sentence 2, in each case in conjunction with an ordinance pursuant to Section 3 (2), fails to ensure that a product bears a number or a mark specified therein,<\/p>\n<p>contrary to Section 7 (2) sentence 1, also in conjunction with sentence 2, or Section 10 (1) sentence 1, also in conjunction with sentence 2, fails to make a declaration or fails to make it correctly, completely, in the prescribed manner or in good time,<\/p>\n<p>fails to ensure that a product is accompanied by instructions for use and the safety information specified therein, contrary to Section 7 (3) or Section 10 (2), in each case in conjunction with an ordinance pursuant to Section 3 (2),<\/p>\n<p>contrary to \u00a7 7 paragraph 5 sentence 1, \u00a7 13 paragraph 1 or \u00a7 14 paragraph 5 sentence 1 does not provide information, does not provide it correctly, not completely, not in the prescribed manner or not in good time or does not hand over a document correctly, not completely, not in the prescribed manner or not in good time,<\/p>\n<p>makes a product available on the market contrary to Section 11 (1) number 1 or (2) sentence 1 in conjunction with an ordinance pursuant to Section 3 (2),<\/p>\n<p>offers or provides a service contrary to Section 14 (1) in conjunction with an ordinance pursuant to Section 3 (2),<\/p>\n<p>contrary to \u00a7 19 paragraph 1 in conjunction with a statutory instrument pursuant to \u00a7 3 paragraph 2, fails to affix the CE marking to a product or fails to do so correctly, completely, in the prescribed manner or in good time, or<\/p>\n<p>affixes a marking, sign or inscription to a product contrary to Article 19(3) in conjunction with Article 30(5), first sentence, of Regulation (EC) No 765\/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Council Regulation (EEC) No 339\/93 (OJ L 218, 13.8.2008, p. 30).<\/p>\n<p>The administrative offence may be punished with a fine of up to one hundred thousand euros in the cases of paragraph 1 numbers 1, 7, 8, 9 and 10 and with a fine of up to ten thousand euros in the other cases.<\/p>\n<ul>\n<li><strong> 38 BFSG Transitional provisions<\/strong><\/li>\n<\/ul>\n<p>Without prejudice to paragraph 2, until 27 June 2030, service providers may continue to provide their services using products that were already lawfully used by them to provide those or similar services before 28 June 2025. However, contracts for services concluded before 28 June 2025 may not continue unchanged until the expiry of the period for which they were entered into, but no longer than 27 June 2030.<\/p>\n<p>Self-service terminals used by service providers before 28 June 2025 to provide services in compliance with the applicable legal regulations may continue to be used to provide comparable services until the end of their economic life, but no longer than fifteen years after they are put into use.<\/p>\n<p><strong>Annex 1 (to Section 28 BFSG) Monitoring of services<\/strong><\/p>\n<p>Monitoring method<\/p>\n<p>The following monitoring method does not add any new requirements to the requirements laid down in the ordinance to be issued in accordance with Section 3 (2), nor does it replace or take precedence over them.<\/p>\n<p>The method is independent of specific tests, accessibility assessment tools, operating systems, web browsers or specific assistive technologies.<\/p>\n<p>The monitoring method is therefore technology-neutral and serves to check the perceptibility, usability, comprehensibility and robustness of the services to be tested.<\/p>\n<p>In the sample, all process steps are checked at least in the standard sequence of a normal user for the provision of the service.<\/p>\n<p>Media disruptions due to non-digital steps must be avoided.<\/p>\n<p>As a minimum, the interaction with forms and user interface controls and dialogue boxes, the confirmations for data entry, the error messages and other feedback resulting from the interaction with the user, and the behaviour of the website or mobile application when using different software or assistive technologies with different settings or default settings are evaluated.<\/p>\n<p>Elements such as documents or necessary external interaction steps that refer to objects outside the user interface are also checked if they are necessary for the successful completion of the interaction.<\/p>\n<p>User-friendliness tests may be included, for example, observing and analysing how users with disabilities or functional limitations perceive and understand the content of the website or mobile application when using different software or assistive technologies and how difficult it is for them to use certain elements of the user interface such as navigation menus or forms.<\/p>\n<p>Samples<\/p>\n<p>For the purposes of this point, \"page\" means a web page or a screen in a mobile application.<\/p>\n<p>The following pages and documents, if available, will be checked:<\/p>\n<p>Start page (Home), registration (Login), site overview (Sitemap), contact, help pages and help functions and pages with legal information;<\/p>\n<p>at least one relevant page for each type of service provided by the website or mobile application that is not already covered by double point (aa) and for each other main purpose, including the search function, that is not covered by double point (aa);<\/p>\n<p>the pages with the information or details on accessibility in accordance with Section 14 (1) No. 2 in conjunction with Annex 3;<\/p>\n<p>exemplary selected pages with a clearly different appearance or other types of content;<\/p>\n<p>at least one relevant retrievable document, if any, for each type of service provided by the website or mobile application and for each other main purpose;<\/p>\n<p>other pages considered relevant by the market surveillance authority;<\/p>\n<p>randomly selected additional pages and documents, if available, amounting to at least 10 per cent of the sample defined under double letters aa to ff.<\/p>\n<p>If one of the pages in the sample selected in accordance with point (b) contains a step in a procedure, all the steps in the procedure referred to in point 1(a) shall be examined.<\/p>\n<p><strong>Annex 2 (to \u00a7\u00a7 6, 9, 18 and 19 BFSG) Conformity assessment procedures for products<\/strong><\/p>\n<p>The conformity assessment procedure is an internal production control procedure whereby the manufacturer fulfils the obligations laid down in points 1, 2 and 3 of this Annex and ensures and declares on his sole responsibility that the products concerned satisfy the appropriate requirements of this Law.<\/p>\n<p>Technical documentation<\/p>\n<p>The manufacturer prepares the technical documentation.<\/p>\n<p>On the basis of the technical documentation, it must be possible to assess the conformity of the product with the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) and, if the manufacturer has relied on Section 16 or Section 17, to demonstrate that compliance with these accessibility requirements would mean a fundamental change or a disproportionate burden.<\/p>\n<p>The technical documentation shall only list the applicable requirements and cover the design, manufacture and operation of the product insofar as they are relevant to the assessment.<\/p>\n<p>The technical documentation contains at least the following elements, where applicable:<\/p>\n<p>a general description of the product;<\/p>\n<p>a list of which harmonised standards and technical specifications, the references of which have been published in the Official Journal of the European Union, have been applied in full or in part, and a description of the solutions used to meet the accessibility requirements of the ordinance to be issued in accordance with Article 3(2) in those points where these harmonised standards or technical specifications have not been applied; in the case of partially applied harmonised standards or technical specifications, the parts that have been applied shall be indicated in the technical documentation.<\/p>\n<p>Manufacture<\/p>\n<p>The manufacturer shall take all necessary measures to ensure that the manufacturing process and its monitoring ensure compliance of the products with the technical documentation referred to in point 2 of this Annex and with the accessibility requirements of this Act.<\/p>\n<p>CE marking and EU Declaration of Conformity<\/p>\n<p>The manufacturer shall affix the CE marking referred to in this Act to each individual product that fulfils the applicable requirements of this Act.<\/p>\n<p>The manufacturer shall draw up a written or electronic EU declaration of conformity for a product sample.<\/p>\n<p>The EU Declaration of Conformity must state for which product it was issued.<\/p>\n<p>A copy of the EU Declaration of Conformity will be made available to the competent authorities on request.<\/p>\n<p>Authorised representative<\/p>\n<p>The manufacturer's obligations set out in point 4 may be fulfilled by his authorised representative, on his behalf and under his responsibility, provided that they are specified in the mandate.<\/p>\n<p><strong>Annex 3 (to Sections 14 and 28 BFSG) Information on services that meet the accessibility requirements<\/strong><\/p>\n<p>The service provider shall indicate in its general terms and conditions or in another clearly perceptible manner how it fulfils the accessibility requirements of the ordinance to be issued in accordance with Section 3 (2) for its service within the meaning of Section 1 (3).<\/p>\n<p>The relevant information shall include a description of the applicable requirements and, where relevant to the assessment, cover the design and implementation of the service.<\/p>\n<p>In addition to the requirements for consumer information pursuant to Article 246 of the Introductory Act to the Civil Code, the information shall in any case contain the following elements, where applicable:<\/p>\n<p>a general description of the service in an accessible format;<\/p>\n<p>Descriptions and explanations that are necessary to understand the performance of the service;<\/p>\n<p>a description of how the service fulfils the relevant accessibility requirements listed in the ordinance to be issued in accordance with Section 3 (2);<\/p>\n<p>the name of the competent market surveillance authority.<\/p>\n<p>In order to meet the requirements referred to in point 1 of this Annex, the service provider may apply in full or in part the harmonised standards and technical specifications the references of which have been published in the Official Journal of the European Union.<\/p>\n<p><strong>Annex 4 (to Sections 17, 21 and 28 BFSG) Criteria for the assessment of disproportionate burden<\/strong><\/p>\n<p>The criteria for the assessment and for the documentation of the assessment are<\/p>\n<p>Ratio of the net costs associated with compliance with accessibility requirements to the total costs (operational and capital expenditure) of manufacturing, distributing or importing the product or providing the service to economic operators; criteria for assessing the net costs associated with compliance with accessibility requirements:<\/p>\n<p>Criteria relating to one-off organisational costs to be included in the assessment:<\/p>\n<p>Costs for additional staff with accessibility expertise;<\/p>\n<p>Costs associated with staff training and the acquisition of accessibility skills;<\/p>\n<p>Cost of developing a new process to incorporate accessibility into product development or service delivery;<\/p>\n<p>Costs associated with the development of accessibility guides;<\/p>\n<p>One-off costs to familiarise yourself with the legal situation regarding accessibility;<\/p>\n<p>Criteria relating to ongoing production and development costs to be included in the assessment:<\/p>\n<p>Costs associated with the planning and design of accessibility features of the product or service;<\/p>\n<p>Costs in connection with the production processes;<\/p>\n<p>Costs associated with testing the product or service for accessibility;<\/p>\n<p>Costs in connection with the preparation of the documentation.<\/p>\n<p>The estimated costs and benefits for economic operators, including production processes and investments, in relation to the estimated benefits for persons with disabilities, taking into account the number of uses and the frequency of use of the product or service concerned.<\/p>\n<p>Ratio of the net costs associated with compliance with accessibility requirements to the economic operator's net turnover.<\/p>\n<p>Criteria for assessing the net costs associated with compliance with accessibility requirements:<\/p>\n<p>Criteria relating to one-off organisational costs to be included in the assessment:<\/p>\n<p>Costs for additional staff with accessibility expertise;<\/p>\n<p>Costs associated with staff training and the acquisition of accessibility skills;<\/p>\n<p>Cost of developing a new process to incorporate accessibility into product development or service delivery;<\/p>\n<p>Costs associated with the development of accessibility
